In a bold move that underscores the ongoing tensions between Democratic leadership and federal authorities, Newark Mayor and Democratic gubernatorial candidate Ras Baraka has filed a lawsuit against interim U.S. Attorney for New Jersey, Alina Habba. Baraka alleges false arrest and malicious prosecution following his arrest on May 9 outside a federal immigration center.
The lawsuit, filed in the U.S. District Court in New Jersey, claims Habba acted with political motives during Baraka’s arrest outside the Delaney Hall detention center, located near Newark Liberty International Airport. Baraka was taken into custody while protesting outside the facility, accused of trespassing and ignoring multiple warnings from law enforcement to vacate the premises. He was detained for several hours before being released, and the charges were dropped 13 days later.
Baraka’s legal team is seeking damages for what they describe as “false arrest and malicious prosecution,” as well as for allegedly defamatory remarks made by Habba on social media. The lawsuit includes screenshots of Habba’s posts, which Baraka’s attorney, Nancy Erika Smith, claims were defamatory. Smith highlighted a tweet from Habba’s personal account where she stated that Baraka had “committed a crime,” labeling it as defamation per se.
Smith remarked, “Habba said in her tweet no one is above the law. I don’t agree with Alina Habba about much, but I agree with that. And today she’s finding out that even she is not above the law.”
Baraka, a vocal critic of Trump’s immigration policies, was briefly charged with criminal trespassing during the protest, which included other public officials like Reps. Robert Menendez, LaMonica McIver, and Bonnie Watson Coleman. Habba maintains that Baraka “ignored multiple warnings” to leave the privately owned ICE detention center, a claim Baraka disputes, suggesting his arrest was targeted.
The lawsuit accuses Habba of acting as “a political operative” and stepping outside her judicial role. It also names Ricky Patel, a DHS Investigations agent in charge in Newark, as a defendant.
This legal battle unfolds as Baraka campaigns for the Democratic gubernatorial nomination, aiming to succeed outgoing Governor Phil Murphy. As Baraka positions himself as a progressive leader, this lawsuit highlights the broader national debate on immigration policies and the role of federal authorities.

When “candidates” are behind in the polls OR they need a boost in their ratings they pull political stunts like this all the time. A bonus for this mayor is that he is black, and blacks like playing the victim card

This is a very poorly worded question. A choice between two options should not have a yes or no answer. The answer should be one option or the other. Very, very poorly written.

They should not have dropped the charges in the first place. Any competent judge (good luck finding one of those, these days!) should throw-out his suit, immediately.
