The family of conservative icon Charlie Kirk came face to face with his accused assassin in a Utah courtroom Monday — marking the first confrontation since the shocking murder that rocked the conservative movement. The preliminary hearing is expected to last a full week as prosecutors lay out their case against Tyler Robinson, 23, who could face the death penalty if convicted.
Robinson was already seated in the Provo courtroom before media entered, dressed in a gray suit, pink shirt and black tie, his wrists and ankles cuffed. What happened next sent chills through observers.
When prosecutors played video footage capturing Kirk’s assassination — complete with audio of the fatal gunshot — Robinson displayed no visible reaction whatsoever. Judge Tony Graf Jr. flinched and leaned away from the screen when the shot rang out. But Robinson remained perfectly still, unmoved by the sound of the bullet that allegedly ended a conservative leader’s life.
Utah State Bureau of Investigation Agent David Hull introduced several videos, including footage of Kirk’s death that were shown only to the judge and attorneys. Two videos reportedly captured the exact moment a sniper’s bullet struck Kirk in the neck during a Turning Point USA event at Utah Valley University on September 10, 2025.
Kirk’s widow Erika and his parents, Rob and Kathy Kirk, had already left the courtroom before the graphic evidence was played. Court officials provided warnings before introducing the most disturbing footage, and the family stepped out twice ahead of mentions of the assassination itself. For much of the hearing, they sat together watching the proceedings closely, occasionally exchanging looks or glancing down.
Other family members in attendance included Erika’s sister Tonya and her niece and nephew. The Kirks had powerful allies by their side — Donald Trump Jr., his wife Bettina, conservative commentator Jack Posobiec, and Brandon Tatum sat near the front in a show of solidarity with the grieving family.
Robinson’s parents, who usually sit in the front row, were relegated to the fourth row Monday with other relatives. At one point when Agent Hull testified about the autopsy report — which officially listed Kirk’s death as a homicide by gunshot wound to the neck — Robinson’s mother leaned over to her husband and placed her hand on his shoulder.
The first witness was Officer Christopher Bagley, now with the Spanish Fork Police Department but working at Utah Valley University security when Kirk was killed. His testimony painted a picture of the immediate aftermath.
“I believed I heard a rifle shot — not a pistol shot — from the direction of the Losee Center,” Bagley testified.
He explained his conclusion came after spotting an empty handgun holster on the ground and realizing the Losee Center rooftop had a clear line of sight to Kirk’s speaking location. When Bagley reached the rooftop, he discovered a black and red screwdriver and impressions in the gravel that resembled a “sniper’s pad.”
He also reviewed surveillance footage allegedly showing the suspect on the roof and found footprints in the grass where the suspect dropped down, along with scuff marks on the roof above them. Defense attorney Kathy Nester challenged Bagley during cross-examination, noting his police report from that day didn’t mention a direction the shot came from. Bagley confirmed it didn’t. He also admitted he didn’t know what happened to the handgun holster found at the scene.
When prosecutors attempted to play UVU surveillance video, Robinson’s defense objected successfully. Judge Graf sustained the objection because the video — which included face blurs, zooms and red circles — had not been properly authenticated. Prosecutors said they would provide an unedited version later.
Other video evidence shown Monday included footage allegedly showing Robinson’s vehicle coming and going from a house near the UVU campus after midnight on September 11 — approximately 12 hours after Kirk’s murder. Law enforcement also had an encounter with Robinson in the area hours after the shooting.
The hearing will resume Tuesday morning at 9 a.m. Mountain Time with Agent Hull returning to the stand. At some point during the week, the court is expected to hear a previously recorded statement from Robinson’s former lover Lance Twiggs, who prosecutors claim received a written confession after the crime.
Robinson has not yet entered a plea. He faces aggravated murder charges and could receive the death penalty if convicted.
