Should People Go to Jail Over Social Media Posts?

A Michigan resident is facing legal threats from Democratic Attorney General Dana Nessel after she posted social media updates alerting voters to changes in voting locations and alleged the township failed to notify residents properly.

Kerry Lynn Elieff, from Ross Township near Kalamazoo, shared her story with The Daily Wire, emphasizing that the cease-and-desist letter she received did not specify which post was allegedly illegal but demanded she remove all “misleading or false election information.” The letter arrived on the day of the state’s primary elections.

Elieff insists her township did not comply with the legal requirement to notify voters of polling location changes within 60 days, as reported by The Midwesterner. She took to social media to inform her neighbors and even submitted a FOIA request for more information, only to be told the results would not be available until two days after the election.

“I was simply informing residents and then I filed a FOIA request. They said they’d provide the information by August 8th, two days post-election,” Elieff explained. “I posted videos and updates with timelines, and then suddenly, I get this letter from Dana Nessel, demanding I ‘cease and desist.’ This is shocking and feels like intimidation to me.”

The letter from Nessel’s office, signed by Criminal Trials Division Chief Robbin N. Liddell, threatened criminal prosecution under Michigan election law, which prohibits spreading “misleading or false election information.”

Elieff says she has deleted some posts and revised others but finds it hard to determine what exactly was deemed misinformation since the letter did not cite specific posts.

Elieff is now exploring legal representation and considering a federal lawsuit in response to the cease-and-desist order.

This incident comes shortly after Michigan Democratic Secretary of State Jocelyn Benson’s office urged voters to report misleading election information. Elieff suspects her political opponents in the township reported her. Adding fuel to the fire, the Republican National Committee earlier sued Benson for allegedly directing local election officials to presume the legitimacy of absentee voter signatures before the February 2024 primary election.

With Michigan being a crucial battleground state in the upcoming 2024 presidential election and a pivotal Senate race to replace retiring Democratic Sen. Debbie Stabenow, this incident highlights growing concerns over election integrity and the lengths to which Democratic officials will go to control the narrative.

    There are plenty of people who actually NEED to be jailed and aren’t. Threatening actual lives should always be investigated but arresting people for “words” is dystopian and right out of the novel 1984.

    I can’t vote yes or no on this one because for me it would depend on the nature of the post. So for me to participate there would have to a third choice…

    If you jailed people for social media posts, then you would have 8 out of ten television newscasters and all of npr in the slammer! That’s all they do is lie and slander

    Legal citizens of any state and this nation should be looking at the real problem of what is going on. As the communists are famous for saying, it does not matter how many people vote, the only thing that counts is who counts the ballots. To me it appears as though this is the problem today along with technology. It appears as though we have grown so use to technology today it can be used against us, by remotely controlling balloting machines, changine figures, and much more which is common knowlege to the general public but denied by the manufacturer. Upon opening the machines it has been found that they indeed can be connected to, programming can be changed either on site or remotely, and ballot counting can occur with no physical presence of people around. These should be addressed, machines should be tamper proof and absolutely no internet connections possible with them. All balloting sites should be monitored by appropriate neutral authorities such as National Guard or Police who have arrest authority over anyone caught minupulating and expelling authority for anyone suspected of minupulation or breaking rules. Our elections MUST be secure from outside interference, honest, and maintain integraty to be believed.

    It can only be disinformation if the information in the post is wrong. If she listed correct polling places then it isnt disinformation. And really what idiot gets polling place and hours from a social media post. In both Texas and Arizona my DL/ID card number entered into a website told me where to vote down to the room number at the c9llege and the days abd hours of operation. In Texas it also told me the total numbers of votes cast.

    Simple solution: simply ban social media altogether. Seriously, only morons post their lives on the internet for all & sundry to see.
    As for the updated polling place info: if Ms. Elieff’s story holds water it’s Dummycrat election officials who should be facing jail.
