The ruling effectively dismantles an attempt by activist groups and local officials to block the 2023 law. The court found that these plaintiffs lacked the standing required to challenge the state’s efforts to maintain public safety.

The court’s 159-page decision emphasized that the plaintiffs failed to show a personal stake in the case. Justice was served by prioritizing the state’s duty to protect its citizens over the demands of open-border activists.

“Texas’s right to arrest illegals, protect our citizens, and enforce immigration law is fundamental,” stated Attorney General Paxton following the announcement.

The Constitution grants states the inherent authority to protect their borders when the federal government fails to do so. This ruling reinforces that state sovereignty is not a suggestion, but a requirement for a functional republic.
