  • The federal government’s shift in legal terminology raises questions about due process and prosecutorial consistency.
  • Protecting the civilian population from violence remains a fundamental duty of the state.

The Trump administration is escalating the prosecution of Brian Cole Jr., the man accused of placing pipe bombs near both party headquarters in early 2021. New charges include armed terrorism and the use of weapons of mass destruction, which could carry a life sentence upon conviction.

Defense attorneys have criticized the government for reclassifying the devices long after the incident occurred.

They argue that the sudden escalation to WMD charges is ill-logical given that experts previously stated the devices would not have detonated.

“For no logical reason at all, the government has gone from identifying the alleged device as an explosive to now referring to that same device as a ‘weapon of mass destruction,’ knowing experts have said this device would not have detonated.”

Prosecutors contend that phone records and vehicle data prove Cole obtained bomb-making components and planted them with the intent to coerce the public. Federal officials highlighted that more efficient use of data allowed them to close this case after a multi-year investigation.

The defense team has attempted to link Cole’s alleged actions to broader executive pardons issued for other protesters from that period. However, the government maintains that the specific nature of these violent threats warrants a unique and severe legal response.

“The government now wants Brian Cole Jr. (a Black man) to go down in history as the only alleged, accused January 6-related individual to serve not only a jail sentence, but to serve the rest of his life in prison.”
