- Biden-era regulation targeting private firearm sales struck down after DOJ abandons appeal
- Acting Attorney General announces ATF rolling back at least 34 oppressive rule changes
- Major Second Amendment victory restores constitutional rights trampled by previous administration
A federal court has formally struck down a Biden administration regulation that targeted private sales of firearms, marking a decisive victory for Second Amendment advocates nationwide. The ruling came after the Department of Justice dropped its appeal, effectively surrendering a regulation that had sparked fierce constitutional challenges.
Acting Attorney General Todd Blanche announced during an April 30 press conference that the Bureau of Alcohol, Tobacco, Firearms and Explosives will publish at least 34 rule changes, rolling back restrictions imposed during the previous administration. The move signals a dramatic shift in how federal law enforcement approaches gun rights.
GOA won our lawsuit against the ATF’s tyrannical Engaged in the Business rule.
It has officially been completely VACATED!
This means that gun owners who buy and sell firearms will be better protected against the kind of ATF raids that murdered Brian Malinowski of Arkansas. https://t.co/U6Lmx0233h pic.twitter.com/Kd3Y5gDqwQ

The Biden-era rule had sought to expand federal oversight of private firearm transfers, effectively treating more Americans as commercial dealers subject to extensive licensing requirements. Critics argued the regulation exceeded statutory authority and infringed on Americans’ constitutional right to keep and bear arms.
The court’s decision reinforces limits on executive branch power to rewrite gun laws through regulatory fiat. For four years, law-abiding gun owners faced an onslaught of administrative actions designed to restrict their rights without congressional approval.
This victory represents more than just one regulation defeated — it’s part of a broader restoration of constitutional governance. When unelected bureaucrats attempt to bypass the legislative process and impose restrictions on fundamental rights, the courts must serve as a check on that overreach.
The ATF’s planned rollback of dozens of regulations suggests the previous administration weaponized the agency against gun owners. Each of those 34 rules likely represented an attempt to chip away at Second Amendment protections through administrative creep.
Gun rights organizations have long argued that the Biden administration used regulatory changes to accomplish what it couldn’t achieve through Congress. This court ruling validates those concerns and establishes important precedent against future executive overreach.
The Constitution must be defended.
