A jailed pregnant woman in Florida is arguing that she should be released because her unborn child is being illegally detained.
Natalia Harrell, 24, has been behind bars since July, when she was charged with second-degree murder for allegedly fatally shooting another woman.
Her attorney filed a writ of habeas corpus in a Florida appeals court, arguing that her fetus is being illegally detained.
Attorney William M. Norris argues that the “unborn child” has not committed any crimes, is innocent, and should be discharged from jail.
“An unborn child has rights independent of its mother, even though it’s still in the womb,” the attorney told The Washington Post. “The unborn child has been deprived of due process of law in this incarceration. You simply have to have the unborn child as a factor in the equation.”

An unborn child has rights independent of its mother! I see a very good argument here to abolish abortion.

EXACTLY!! Besides, an unborn child has no idea that it’s mother is in detention, as it’s environment is unchanged until it’s birth. A womb is a womb no matter where the womb is located. Pregnant persons should be afforded adequte and appropriate medical and nutritional care, but not released from jail. The emphasis should be on finding a guardian for the child once it is born.

so now the problem can be Pregnant women will start killing people because she will get out of Prison because she is pregnant. since the child is inside of her the child is being falsely imprisoned inside this woman. the child didn’t do anything to be stuck inside her. so she is guilty of False Imprisonment. Kick this one around for a while.

Ummm I’ve worked in the prison system. The baby TRUELY hasn’t taking it’s first breath yet therefore how does it know what prison is. It deserves the same rights to not be with someone that is a drug addict or offender also. When the baby is born guess what it’s NOT in a prison but a hospital. Regardless they even have blocks for offenders that have babies. I’d say it’s A LOT safer than being in the world on the outside w/ a drug addict or offender that breaks laws to have to serve debt to society. There’s plenty of parents that can’t have kids and won’t kids. But it’s easier for a legitimate family from being together for them to buy a kid from overseas basically in adoption.

This baby should be given up for adoption when he or she is born. The mother should remain in prison until time for the baby to be born and return to prison afterwords. This baby will not know that he or she was in prison in the mother’s womb unless someone tells him or her. The argument used here is an argument against abortion. The pro abortion groups will not admit this is a life worth protecting.

They did the crime, they need to do the time, pregnant or not. Should have thought about their baby before they got involved in something that would land their butt in jail. Actions have consequences. People need to learn this fact.

Democrats once again contradict themselves- Hypocrites! Pro-choice- there is NO baby, it has no rights. To them- It’s not even a baby when aborted at 9mths! Only the ‘birthing person’ can decide to abort (for any reason). But here, admitting the thing growing inside a woman IS a Baby and has rights. So, the baby only counts for women in jail? WTH make up your minds demos. This article should be spread far and wide by Pro-life and force Pro-choice to pick a side. Either it is or it isn’t. Can’t have it both ways! ‘Attorney’ admits and argues a baby is a baby and has rights- but outside the jail, there is no such thing as a mother or baby to the leftist lunatics death cult! The mother committed murder she deserves to be in jail. The baby once it is born needs to be removed from the prison and if mom gets life the baby is given a chance to be adopted by the father or grandparent his or hers if they chose not to then the baby goes up for adoption. This has gone on for years in prison. The mother committed a serious crime and now wants to get out because her child is an innocent in this. What about the woman she killed I think she was just as innocent as the baby. But momma needs to stay where she is. Baby goes up for adoption . Problem taken care of.

Her baby does not know that he or she is in prison and will not be in prison at birth. All children are where their mothers are during pregnancy, but none knows where the mother is at this time. This baby should be placed for adoption after birth in the hospital. Her lawyer knows that this is a baby in her womb while the pro abortion crowd denies this.

I think it has already been argued that the unborn doesn’t care. If you release in this case a murderer they will easily escape then put child in jeopardy because of mothers poor health due to drug/alcohol issues, diet, and shelter while on the run. Nah keep them locked up. Are you going to give male murderers permissive leave to visit all their ‘TV’ show sex-mates? No of course not. Thanks

She made the decision to have the child, and that was an option. However we can’t have all those having a baby allowed out of jail. The child should be turned over to a family member who wants the child, If none are available, then place the child up for adoption.This person had to commit a crime, and being in jail is not a reason to get out. Most likely she would be a Poor example of a mother, and may be better going with the father, or his family. This is just a ploy for getting out of something she commited.
